Cabotage: Rules for Foreign Carriers Operating Domestically

In road freight, cabotage means providing transport services within one country by a transport company established in another. Cabotage is permitted in the EU but limited in time and number in order to prevent distortions of competition.

The EU cabotage rules

Under EU Regulation 1072/2009, a foreign EU carrier may perform a maximum of 3 cabotage operations within 7 days in the destination country following an international delivery. Once that period expires the vehicle must leave the country. The rule applies between all EU member states. Since 2022 cabotage has been checked more strictly in Germany and other EU countries.

Checks and documentation requirements

The documents that must be produced: CMR consignment notes for the preceding international journey, CMR consignment notes for all cabotage operations, the Community licence and the driver attestation. Customs and trade supervisory authorities carry out roadside checks. Incomplete documentation counts as a breach.

Consequences of a cabotage breach

Fines of up to 20,000 euros are possible in Germany. The vehicle can be detained until the matter is resolved. Repeated breaches can lead to withdrawal of the Community licence. For customers: in certain circumstances shippers too can be held liable if they knowingly facilitate cabotage breaches.
